Learned advocate appearing for the petitioners submits that the subject matter of recovery in the present case is 425 gms. of brown sugar from the joint possession of the petitioners. Petitioners were arrested on 10th January, 2026 and since then they are in custody. Charge sheet has been submitted before the jurisdictional court. Learned advocate appearing for the State submits that the prosecution by way of 9 witnesses has substantiated their case. Learned advocate for the petitioners refers to the chemical examiner’s report. The said reports reflects that presence of four contrabands Diacetylmorphine (Heroine), 6 Monoacetylmorphine, Morphine and Codeine. 2 Having regard to the judgment of the Hon’ble Supreme Court in Sentu Seikh versus State of West Bengal (SLP (Crl.) No. 13987 of 2025, I am of the opinion that the petitioners are entitled to be released on bail. Thus, prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned Judge, NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District Malda without the prior permission of the learned Special Court.
