IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH **** 166 CR-5102-2026 (O&M) Date of Decision.:21.07.2026 Shelly Parmar and Another
…..Pe22oners Vs. Manju Sharma
.….Respondent
CORAM:- HON'BLE MR. JUSTICE DEEPAK GUPTA Present:- Mr. Mohit Jaggi, Advocate for the peoners. Mr. Arvind Kashyap, Advocate for the caveator- respondent. **** DEEPAK GUPTA, J. (ORAL) CM-12925-CII-2026: This is an applicaon under Order XXII Rule 3 read with Secon 151 of the CPC to bring on record LRs of deceased Uma Handa, who was one of the respondent before learned Rent Controller. Applicaon is supported by affidavit of Shelly Parmar wife of Balvir Singh. As Shelly Parmar is stated to be the only legal heir, so the applicaon is allowed subject to all just and legal excepons. Amended memo of pares already filed, is taken on record. Main case.: The present revision peon has been preferred by the tenants under Secon 15(5) of the East Punjab Urban Rent Restricon Act, 1949, assailing the
order dated 08.10.2024 passed by the learned Rent Controller, Hoshiarpur whereby the evicon peon instuted by the respondent-landlord under Secon 13 of the East Punjab Urban Rent Restricon Act, 1949 was allowed on the ground of bona fide personal requirement. The appeal preferred by the peoners NEETIKA TUTEJA 2026.07.23 10:58 I attest to the accuracy and integrity of this document
CR-5102-2026 (O&M) against the said order also came to be dismissed by the learned Appellate Authority, Hoshiarpur vide judgment dated 24.04.2026, thereby affirming the
order of ejectment.
2. Aggrieved against the aforesaid concurrent orders, the present revision peon has been filed.
3. At the very outset, however, learned counsel appearing for the peoners, without entering into arguments on the merits of the controversy, submi?ed that the peoners would confine their prayer to seek reasonable me to vacate the demised shop. It is prayed that the peoners may be granted a period of nine months to hand over vacant possession of the premises.
4.
Learned counsel appearing for the respondent-landlord opposed the request by poinng out that while passing the evicon order on 08.10.2024, the learned Rent Controller had already granted one month's me to vacate the premises. It is submi?ed that the peoners thereaAer connued to remain in possession during the pendency of the statutory appeal, which ulmately came to be dismissed on 24.04.2026. According to the learned counsel, grant of a further period of nine months would be wholly unreasonable. Nevertheless, on instrucons received from the respondent, learned counsel fairly submi?ed that the respondent would have no objecon, if a period of six months is granted to the peoners to vacate the premises, subject to appropriate safeguards. 5. Having considered the submissions advanced by learned counsel for the pares, this Court is of the view that the request for grant of reasonable me deserves to be accepted. The pares have substanally arrived at a consensus regarding the period within which the premises shall be vacated. Since the arrangement adequately balances the equies between the pares by protecng the landlord's right to obtain possession while simultaneously affording the tenant reasonable me to make alternave arrangements, the same deserves to be incorporated in the order.
