JUSTICE RAVI CHIRANIA Order 27/02/2026 The instant second bail application has been filed by the applicant Rahul Saini S/o Shri Ramesh Chand Saini, under Section 483 of B.N.S.S. who is behind the bars since 25.09.2025 in connection with the FIR bearing No.414/2025 dated 26.09.2025 registered at Police Station Aravali Vihar, Alwar, for the offences under Sections 318(4), 61(2) BNS and Section 66 of the I.T. Act, 2000. The first bail application of the present applicant was dismissed as withdrawn with liberty to file fresh application after recording of the statement of the Investigating Officer. The second bail application has been filed as the charge- sheet has been filed and the statement of the Investigating [2026:RJ-JP:9316] (2 of 3) [CRLMB-3044/2026] Officer, namely, Rameshwar Lal (Inspector) has been recorded by the learned Trial Court as PW-3. Apart from that the statement of other witnesses, namely, PW-1 Vijay Singh and PW-2 Samay Singh and police personnel have also been recorded. Learned counsel for the applicant specifically referred that according to the statement of the Investigating Officer, who has not collected any bank statement, which may show the nexus between the petitioner and Mohit Saini and other persons. In the absence of the bank statement and any corroborative evidences, It cannot be proved that the petitioner has committed the alleged offences. In view thereof, learned counsel for the applicant has prayed that the petitioner may be enlarged on bail. Learned Public Prosecutor strongly opposed the bail application. This Court considered the fact that the charge-sheet has been filed in this case on 22.11.2025 and the statement of the Investigating Officer and other police witness have already been recorded by the learned Trial Court. As noted above, the allegations are in respect of amount of Rs.51,000/- and Rs.48,000/- amounting to Rs.99,000/- in total. Apart from that, there are no other proved allegations against the petitioner. This Court also considered the statement of the Investigating Officer Rameshwar Lal, PW-3 while going through his statement, this Court noted that the Investigating Officer is not aware of as to how to investigate the matters relating to cyber crimes, without making any comments on the merits of the case, this Court is inclined to enlarge the present petitioner on bail. [2026:RJ-JP:9316] (3 of 3) [CRLMB-3044/2026] The petitioner is directed to give the details of his social networking IDs, bank statements, mobile phone number and other digital details to the SHO of the police station where he is residing, who shall monitor his conduct for two years from the date of passing of this order. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-applicant Rahul Saini S/o Shri Ramesh Chand Saini shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The applicant is further directed not to take an undue advantage of liberty or misuse liberty.
