JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in CC No.1248 of 2019 registered for the offences punishable under Sections 120-B, 114, 363, 344, 365, 368 read with Section 149 of the IPC. 2. Heard Smt Shilpa Rani, learned counsel appearing for the petitioners, Smt M M Waheeda, learned High Court Government Pleader appearing for respondent No.1, Sri S Rajesh, learned counsel appearing for respondent No.2 and have perused the material on record. - 4 - HC-KAR CNR: KAHC010548782026 NC: 2026:KHC:41932 CRL.P No. 11929 of 2026 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT OF PETITIONER NOS.1 TO 3 AND RESPONDENT NO.3 We, 1. Ravi S/o Kamanna, Aged about 44 years, R/at No.33/3 Chamapadamma Layout, Near Balaji Kalyana Mantapa, Bannerughatta, Bengaluru-560 083, Petitioner No.1/Accused No.2; 2. Smt. Yashoda, W/o Ravi, Aged about 36 years, R/at No.33/3, Chamapadamma Layout, Near Balaji Kalyana Mantapa Bannerughatta, Bengaluru-560 083, Petitioner No.2/Accused No.3; 3. I Ramadas, S/o Thimmegowda, Aged about 55 years, R/o Munilingaiah Street, Malagalu, Kanakapura-562 117, Bengaluru South District, Petitioner No.3/Accused No.6; and 4. Smt. Meghana Mahesha, Respondent No.3, W/o Pradeep R, Aged about 21 years, Residing at Dhruv Poultry Farm, Hullepura, Yadahalli Doddi Road, RS Doddi, VTC: Hanur, District Chamarajanagar-571 439, Respondent No.3, all are fully acquainted with the facts of the case, do hereby solemnly affirm and state on oath as follows: 1. Petitioner Nos. 1 to 3 are the Petitioners in the accompanying Criminal Petition. Respondent No.3 is the alleged victim in the criminal case and the legally wedded wife of Accused No.1. We are all well acquainted with the facts and circumstances of the case and are therefore competent to swear to this joint affidavit. 2. Respondent No.3 states that she voluntarily left her parental house on 15.08.2019 and accompanied Accused No.1 out of her own free will, volition and consent. She was neither kidnapped, abducted, induced nor compelled by any person to accompany - 5 - HC-KAR CNR: KAHC010548782026 NC: 2026:KHC:41932 CRL.P No. 11929 of 2026 Accused No.1. These facts are consistent with the factual basis of the principal petition. 3. Respondent No.3 further states that Petitioner No.1 (Accused No.2), Petitioner No.2 (Accused No.3) and Petitioner No.3 (Accused No.6) had absolutely no role whatsoever in her leaving the parental house. They never abducted, wrongly confined, concealed harboured, threatened, induced or compelled her at any point of time. 4. Respondent No.3 further state the allegations made against the present petitioners are wholly false and baseless. They have been arrayed as accused only because they are close relatives of Accused No.1. 5. Respondent No.3 further submits that she and Accused No.1 were in love and voluntarily decided to marry each other. Their marriage was solemnized according to Hindu rites and customs on 02.02.2024 and subsequently registered before the competent authority. Out of the said wedlock they have been blessed with a female child and are happily residing together as husband and wife. These events are reflected in the principal petition. 6. Respondent No.3 has absolutely no grievance or complaint against the present Petitioners. She has no objection whatsoever if the criminal proceedings pending against Petitioner Nos.1 to 3 are quashed by this Hon'ble Court. 7. Petitioner Nos.1 to 3 submit that they are innocent and have never participated in any act constituting the offences alleged in the charge-sheet. They have been falsely implicated solely because of their relationship with Accused No.1. 8. We jointly submit that continuation of the criminal proceedings against Petitioner Nos.1 to 3 would serve no useful purpose. On the contrary, it would unnecessarily disturb the peaceful matrimonial life of Respondent No.3 and Accused No.1 and - 6 - HC-KAR CNR: KAHC010548782026 NC: 2026:KHC:41932 CRL.P No. 11929 of 2026 adversely affect the welfare and future of their minor daughter. 9. We respectfully submit that the continuation of criminal proceedings against the present petitioners would amount to an abuse of the process of the Court, as Respondent No.3 herself categorically supports the Petitioners and does not attribute any criminal act to them. 10. We state that this affidavit has been executed voluntarily, without force, coercion, undue influence or pressure from any person whatsoever. The statements made herein are true and correct to the best of our knowledge, information and belief. 11. We respectfully pray that this Hon'ble Court may be pleased to take this Joint Affidavit on record and, in the light of the facts stated herein, allow the accompanying Criminal Petition by quashing the criminal proceedings in C.C. No.1248/2019 against Petitioner Nos.1 to 3 (Accused Nos.2, 3 and 6) in the interest of justice and equity." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5.
