ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in crime No.65/2025 registered for the offences punishable under Sections 316(2), 318(4), 318(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita (BNS), 2023.

Sri. Akshay Raj B.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows:
"JOINT AFFIDAVIT
We, K.S.Mahesh, S/o K.L.Subbarathnagupta, aged about 43 years, R/at No.474, Railway Station Road, Gowribidanur Town and Taluk, Chikkaballapura District- 561 206, and
S.Ramesh S/o Subbarayappa, aged about 55 years, R/at Barjankunte Village, Tondebavi Hobli, Gowribidanur Town and Taluk, Chikkaballapura District- 561 206, do hereby solemnly affirm and state as follows:
1. We state that we are the petitioner and Respondent No.2 respectively, in the above case, and we are well acquainted with the facts and circumstances of the case. Hence, we are swearing to this joint affidavit. 2. The Petitioner is the accused No. 1. 3. The Respondent No. 2 is the Complainant in Crime No.65/2025 for offences punishable under section 3(5), 316(2), 318(4), 318(2), 351(2), and 352 of BNS against the Accused No.1. 4. We state that all are Friends and business partners. 5. That the complaint and FIR was filed due to some misunderstanding in our business transactions. - 4 -

The petitioners regret the same. On the intervention of well-wishers, elders and friends, we have amicably settled the business account and all transactions amongst ourselves. The Petitioner paid a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) through cheque bearing No 941322 drawn on State bank of India, on 23/07/2026 and further a sum of Rs 13,50,000/- (Rupees Thirteen Lakhs Fifty Thousand Only) is paid through Cheque bearing 000064 dated 29/07/2026 drawn on HDFC Bank, Gowribidanur Branch, Thus, a total sum of Rs 15,50,000/- (Rupees Fifteen Lakhs Fifty Thousand Only) is paid as full and final settlement towards the claims of Respondent No.2. In view of the said settlement we do not intend to precipitate the matter further. As such, we have amicably decided to close the matter. 6.
We state that respondent no 2 has voluntarily withdrawn all the allegations made in the complaint against the petitioner and has no objection whatsoever to the quashing of the FIR and all consequential proceedings arising therefrom. 7. We state that the aforesaid settlement has been entered into voluntarily out of our own free will and consent, without any force, coercion, undue influence or pressure from any person whatsoever. 8. We state that in the light of the above, this Hon'ble Court may be pleased to allow the above Petition and quash the Crime No. 65/2025 for offences punishable under section 3(5), 316(2), 318(4), 318(2), 351(2), and 352 of BNS. What is stated above is true to the best of our knowledge, belief and information."
4. In the light of application for compounding being filed along with the joint affidavit and offences not being

against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER (i) Criminal Petition stands disposed. (ii) The investigation in crime No.65/2025 pending before the II Additional Senior Civil Judge and JMFC at Chikkaballapura, against the petitioner stands quashed.
