Zahid Abedin ….for the respondent no. 5 1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. A case is made out that in spite of lodging complaints no FIR is registered and there is inaction on the part of the concerned police authorities in taking steps based on complaints lodged by the petitioner. 3. Learned advocate representing respondent no. 5 opposes writ petition and it is submitted several legal proceedings have been initiated by the petitioner including a Title Suit and those are pending. 4. Learned advocate representing the State respondents has filed a communication dated 9th August, 2 2026 of Officer-in-Charge of Kasba Police Station and same is taken on record. Copies of said communication are made over to learned advocates representing the petitioner and respondent nos. 5. 5. It is disclosed in communication dated 9th August, 2026 that FIR has been registered being Kasba Police Station Case No. 440 dated 8th August, 2026 under certain provisions of Bharatiya Nyaya Sanhita, 2023. In addition thereto, it is also disclosed in said communication that previously there was another FIR being Kasba Police Station Case No. 42 dated 11th February, 2022 under certain provisions of Indian Penal Code. 6. In view of steps taken by the concerned police authorities by registering FIR, no further order need be passed on this writ petition. 7. Writ petition stands disposed of. 8. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Saugata Bhattacharyya, J.)
