In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Tamluk Police Station Case No. 480 of 2022 dated 07.06.2022 under Section 376(3) of the Indian Penal Code and Sections 4/6 of the Protection of Children from Sexual Offences Act, 2012 and Sections 67/67A/67B of the Information Technology Act.

In Re : Sharuk @ Sk. Musaraf ... Petitioner.
Mr. Amal Kumar Samanta
... For the Petitioner.
Mr. Imran Siddiqui
... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than four years and till date, the evidence has not been completed. A supplementary charge-sheet has been submitted along with four witnesses proposed to be examined by the prosecution. It has also been submitted that there was earlier direction to complete the trial within a fixed period of time, yet the same has not been complied with. I have taken into account the earlier observations of the Division Bench of this Hon’ble Court which specifically states that petitioner was allegedly involved in penetrative sexual assault and blackmailing the victim by way of uploading objectionable pictures in the social media. Having considered the complicity of the present petitioner and subsequent evidence being obtained, I am not inclined to
2 release the petitioner on bail in spite of the time period which has passed. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 1075 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
