05.08.2026 Court No.35. D/L.251. Rakib (Rejected)
CRM (M) 1654 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Duttapukur Police Station case no. 286 of 2021 dated 03.05.2021 under Sections 302/34 of the Indian Penal Code and Section 9B of the Indian Explosive Substances Act.
And In the matter of : Nazir Hossain.
……Petitioner. Mr. Sekhar Barman Mr. Rameswar Sinha
.....for the Petitioner. Mr. Amajit De, Special PP, CBI
……for the CBI.
Learned advocate appearing for the petitioner submits that petitioner has been falsely implicated in connection with the instant case and was unaware regarding such criminal case pending. All on a sudden petitioner was arrested and was taken by surprise. Learned Special Public Prosecutor appearing for the CBI opposes the prayer for bail in view of the petitioner absconding for more than four and half years. I have taken into account the time period for which petitioner was absconding and having regard to the same, I am of the opinion that the petitioner do not deserve to be released on bail at this stge. Accordingly, the prayer for bail of the petitioner in CRM (M) 1654 of 2026 is dismissed. Report submitted by the CBI be kept with the record.
