This application under Article 227 of the Constitution of India is at the instance of the third party challenging an order being No. 30 dated 7th July, 2026 passed by the learned Judge, 4th Bench, City Civil Court at Calcutta in Misc. Case No. 5358 of 2025. By the order impugned, the Misc. Case under Order 21 Rule 101 of the Code of Civil Procedure stood disposed of. The said order being a deemed decree under Order 21 Rule 103 of the Code of Civil Procedure, this Court is not inclined to entertain this civil revisional application. Faced with such situation, the learned advocate appearing for the petitioners prays for leave to withdraw this civil revisional application with liberty to approach the appropriate forum in accordance with law. In the light of the submission made by the learned advocate for the petitioner, this civil revisional application stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law challenging the self-same order. The learned advocate on record for the petitioner is permitted to take back the certified copy of the order by replacing the same with a Photostat copy thereof.
