THIS REVISION PETITION COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
Both the parties present. Both the learned counsel representing the parties, are present. The parties in this petition have filed Joint Memo. The same reads thus:
" JOINT MEMO
The CRL. RP NO. 487/2025 filed against the
judgment passed in CC.No.59801/2018 dated:08.12.2023 by the court of the learned XXXIV ACJM, Mayo Hall Unit, Bengaluru & CRL.A.No.25007/2024 dated 05.12.2024 passed by learned LXXIV Addl. Judge, Court of Addl. City Civil and Sessions Judge, Mayo Hall Unit, Bengaluru (CCH-75), have been settled between the parties on the following terms and the same may kindly be modified as under: The Petitioner and the Respondents respectfully submit as under:- 1 At the instances of well wishers and friends of the Petitioner and Respondents, the Petitioner and the Respondents above named wants to settle the matter amicably. Out of the total fine amount of Rs.3,85,000/- both parties are agreed for amount of Rs.3,75,000/- (Rupees Three lakh seventy five thousand only) as full and final settlement. The petitioner have already paid/deposited Rs.2,25,000/- by way of DD, before the learned trial court in above mentioned CC Number. 4
The Petitioner/Accused have already paid the following amounts in following manner: i. Rs.30,000 as per Order dated:14.01.2020 vide way of DD dated:04.03.2020 deposited in the name of XXXIV ACMM (at ACJM) Court. ii. Rs.39,000 vide way of DD No.506684, dated:23.01.2024 deposited in the name of XXXIV ACMM (at ACJM) Court as per order by the Addl. Session Court. iii. Rs.1,00,000 as per Agreement between parties in name of respondent R.Prasanna DD No.518248, dated:14.02.2025 before the court of XXXIV ACMM (at ACJM) Court & encashed by the respondent. iv. Rs.56,000 as per the order dated by this Hon'ble High Court dated:18.06.2026, vide way of DD No.518451, dated:20.06.2026 before the court of XXXIV ACMM (at ACJM) Court. 2. The petitioner submit that the trial court convicted petitioner under section 138 of NI Act and sentence in CC.No.59801/2018 dated: 08.12.2023 by the court of the learned XXXIV ACJM, MAYO HALL UNIT, BENGALURU convicting the petitioner and sentencing him to pay a fine of Rs.3,85,000/- and Rs.5,000/- to the state in default to undergo simple imprisonment for a period of three months. Out of convicting amount of Rs.3,85,000/- the petitioners have already deposited/paid an amount of Rs.2,25,000/-. 5

Moreover both parties under amicable and free will out of their own choice have decided to settle this matter once and for all in the present Lok-Adalath by way of amicable and mutual settlements, where by the petitioners has agreed to deposit Rs.1,50,000/- by way of DD as a full and final settlement to be deposited before the learned Trial Court 34th ACMM (At ACJM) Court. 4. That respondent on the above terms and conditions have agreed that he will not object to the present CRL.RP. NO.487/2025 to be allowed and the Trial Court judgments and other orders be quashed and set-aside and his consent is approved by this joint memo. 5. Wherefore, the petitioner and respondent above named parties respectfully prays that this Hon'ble Court be pleased to pass a judgment on the above terms and conditions in the above case. Hence the parties have compromised in terms of the above."
2. Both the parties and their advocates have affixed their signature to the Joint Memo. The contents of Joint Memo has been read over and explained to the parties. Both the parties have voluntarily accepted the terms and conditions of the compromise petition. The same is accepted as the same is lawful. 6
3. In view of the Joint Memo, accused-Revision Petitioner is acquitted of the offence under Section 138 of Negotiable Instruments Act. 4. As per the Joint Memo, Rs.2,25,000/- is already deposited before the trial Court. The trial Court is directed to release the amount of Rs.2,25,000/-, which is already deposited by the petitioners. It is made clear that if the Revision Petitioners fail to make payment as per the Joint Memo, this Criminal Revision Petition shall stand restored to its file. Sd/- JUDGE
