1. Petitioner has filed this writ petition seeking following reliefs:
“10.1. That, this Hon'ble Court may kindly be pleased to issue a appropriate writ/directing, directing the respondent authorities to disburse/distribute the amount of compensation to the petitioner as determined under the provisions of the National Highway Act, 1956. 10.2. That, this Hon'ble Court may kindly be direct the respondent authorities for payment of interest on the amount of compensation from the date of notification to date of actual payment to the petitioners. 10.3. Any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.”

Learned counsel appearing for respondent No.2 would submit that the award of compensation passed in Case No.185 A-82/2018-19 is challenged by respondent No.2/ NHAI in proceeding under Section 34 of the Arbitration and Conciliation Act, 1996 (for short “Act of 1996”). He contended that in the proceeding filed under Section 34 of the Act of 1996, quantum of compensation is questioned and therefore no
3 / 3 relief as prayed for by the petitioner can be granted. He submits that once there is an award by the Arbitrator, petitioner is having remedy to file appropriate application for execution under Section 36 of the Act of
1996.
He also submits that next date fixed in proceedings under Section 34 of the Act of 1996, before the XI District Judge, Bilaspur is
18.09.2026. 3. In view of the submission made by learned counsel for respondent No.2 which is not disputed by learned counsel for the petitioner that award passed in Case No.185 A-82/2018-19 is challenged in the proceeding under Section 34 of the Act of 1996, I am of the view that no relief can be granted to petitioner, pending application under Section 34 of the Act of 1996, and further remedy available under Section 36 of the Act of 1996. 4.
