This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.608/2026 registered at Police Station Sarkanda, District Bilaspur (C.G.) for the offence under Sections 296, 115(2), 351(3), KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.07 17:34:15 +0530

Case of the prosecution is that on 1.5.2026 at about 10.30 am near RSK Academy, Mahamaya Chowk, Sarkanda, a quarrel allegedly took place between injured Anubhav Soni and the accused persons on account of previous enmity. It is alleged that applicant Raj Pali along with co- accused Rishu Singh Thakur abused the injured and assaulted him with scissors, a stick and fists, causing injuries on his neck and left eye. The injured was thereafter admitted to Pratham Hospital, Sarkanda, Bilaspur, where he received treatment. On the basis of the report lodged by the complainant Ravi Kumar Soni, the present crime came to be registered against the applicant and the co-accused. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. He further submits that on similar allegations, co-accused Prashant Singh @ Rishu has been granted anticipatory bail by this Court vide order dated 16.6.2026 passed in MCRCA No.763/2026 and the applicant has 4 criminal antecedents out of which 2 cases have been decided and 2 cases are pending. The applicant is in jail since 14.7.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant and learned counsel for the objector would oppose the
3 bail application.
They submit that the applicant is the captain of the cricket team and he was having personal grudge with the injured and the applicant has caused injuries by scissor on the face of injured as a result of which the injured suffered one lacerated wound and one incised wound on his eye and neck and as per the MLC report, the injuries are grievous in nature. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the applicant is the captain of the cricket team and he was having personal grudge with the injured and the applicant has caused injuries by scissor on the face of injured as a result of which the injured suffered one lacerated wound and one incised wound on his eye and neck and as per the MLC report, the injuries are grievous in nature, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Raj Pali, involved in Crime No.608/2026 registered at Police Station Sarkanda, District Bilaspur (C.G.) for the offence under Sections 296, 115(2), 351(3), 118 (2) & 3 (5) of the BNS, is rejected.
