Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. The petitioners who are members of the Jatradanga Gram Panchayat submitted a no confidence motion before the Prescribed Authority for removal of the Pradhan of the Panchayat pursuant to which the Prescribed Authority by a notice issued on 14th August, 2026 fixed the date of meeting on 25th August, 2026. The petitioners seek a direction upon the police authority for rendering adequate police assistance so that the meeting may be held peacefully without any hindrance and the members are able to participate in the meeting and cast their votes safely and independently. It appears from the report submitted by the State that the Prescribed Authority has also made communication to the Inspector in Charge, Malda Police Station to render necessary assistance for maintenance of law and order in the meeting fixed on 25th August,
2026.
2 In view of the above, the Inspector in Charge Malda Police Station, being the 7th respondent herein, is directed to render necessary assistance to the Prescribed Authority and Block Development Officer, Old Malda Development Block, being the 5th respondent herein, so that the meeting is held peacefully without any disturbance from any corner whatsoever. The police authority shall ensure safe passage of the members of the Panchayat including the petitioners to the venue so that they are able to cast their votes freely, safely and independently. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Parties are at liberty to communicate the gist of the order to the concerned authority at the earliest. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
