“10.1. That this Hon'ble Court may kindly be pleased to direct the respondent No. 1 to bring the pay parity and to enhance the grade pay and pay scale of the post of warden in the department of Director Medical Education in accordance with law to ensure fairness and transparency. 10.2 Any other relief, which may be deemed fit and proper in the facts and circumstances of the case may also be allowed.

Learned counsel for the petitioners submits that the petitioners are working as Warden under Director Medical Education and posted at Government Nursing College, Rajnandgaon and Government Nursing College, Jagdalpur respectively. Petitioners came to know that the pay which is being paid to the petitioners is not equal to the pay which is being paid to the Wardens working under Directorate, Health Services, who are also holding the same post. Petitioners had raised earlier grievance before the respondent No.2 and the respondent No. 2 upon considering the nature of grievance as raised, wrote letter to respondent No. 1 on 06.08.2018, however till date no decision has been taken and therefore, direction be issued to respondent No. 1 to consider and take decision on the letter written by respondent No. 2 within specified time period. 3. On the other hand, learned counsel for the Respondents/State submits as learned counsel for the petitioners is only seeking a direction to respondent No.1 to consider and take decision on the letter forwarded by respondent No. 2, he is having no objection to the limited prayer. If the letter written by respondent No. 2 is still pending for consideration, it will be considered in accordance with law. 4. I have heard learned counsel for the parties and perused the

On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance as raised by the petitioners is with regard to disparity in pay scale and equality between the Wardens working with the Director Medical Education and the Wardens working with Directorate Health Services. Respondent No. 2/ Director Medical Education wrote letter dated 06.08.2018 to respondent No. 1 to bring to their notice about the disparity in pay. According to submission of learned counsel for the petitioners, the decision is not taken till date. 6. In view of the above facts and circumstances of the case, this writ petition at this stage is disposed of directing respondent No. 1 to consider and take decision of letter dated 06.08.2018 forwarded by respondent No.2 in accordance with law, expeditiously, preferably within a period of 06 months from the date of receipt of the order. The petitioners shall enclose the copy of the letter dated 06.08.2018 along with the order passed by this Court to be placed before respondent No.1. 7.
With the aforesaid observation and direction, this writ petition stands
