Mr. Subhayan Barik ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Contai, District-Purba Midnapore to dispose of the Title Suit No.37 of 2024 as well as the applications filed in the said suit expeditiously. The learned advocate appearing for the petitioner submits that the injunction application is still pending. He further submits that the injunction application is otherwise ready for hearing. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2701 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 1st Court at Contai, District-Purba Midnapore to take up the hearing of the injunction application filed by the 2 petitioner on the next date fixed, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 12 weeks from the next date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the injunction application as well as any other interlocutory applications that may be pending, the learned trial judge shall make an endeavour to dispose of Title Suit No.37 of 2024 as expeditiously as possible. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
