1. Heard the present writ petition on final disposal at admission stage.
2. The limited grievance of the petitioner is that the petitioner was suspended by proceedings dated 16.10.2025 in contemplation of disciplinary proceedings and his grievance is that once the petitioner is suspended, the petitioner is entitled for subsistence allowance as is provided under Rule
[2026:RJ-JP:18135] (2 of 2) [CW-7862/2026] 53 of Rajasthan Service Rules, therefore, he seeks direction to the respondents. It is also submitted that the petitioner has also submitted several representation before the respondents, however, the subsistence allowance has not been given to him yet.
3. In view of the submissions made, the respondents are duty bound to give the subsistence allowance to the petitioner during the suspension period and statute give such a right to the suspended person for entitlement of subsistence allowance and non-grant of subsistence allowance is clearly violation of statutory provisions, therefore, the present writ petition is disposed of directing the respondents to pay the subsistence allowance in term of Rule 53 of RSR to the petitioner and arrears shall also be paid within a period of one month from the date of receipt of this Order.
