Syed Ruhullah Shah & Ors.” under Order XXXIX, Rule 1 & 2 CPC. 2. The impugned order passed by the trial court, in terms of Order XXXIX Rule 1 & 2 CPC, on the face of it, is appealable under Order XLIII CPC, but the petitioner has straightway approached this Court, without availing the statutory remedy of appeal. 3.
