CRM (M) 1030 of 2026
In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Chandipur PS Case No. 475 of 2024 dated 26.12.2024 u/s 103(1)/3(5) of the BNS.

In the matter of : Debasis Maity @ Bipul Maity
… Petitioner(s)
Mr. Arup Kumar Bhowmick
… for the Petitioner(s)
Mr. Krishnendu Bhattacharjee Mr. Subrata Mukherjee Mr. Sanjib Das
… for the State-respondent(s)
Learned advocate for the petitioner submits that the petitioner was arrested on 20th January, 2025 and since then he is in custody. Learned advocate also submits that only few witnesses have been examined, as such, there is no possibility of the trial being concluded in the near future. Learned advocate for the State opposes the prayer for bail. I have taken into account the earlier order passed in CRM (M) 1327 of 2025. Having considered that there is no change of circumstances and taking into account the gravity of the offence which involves gang rape with murder, I am not inclined to enlarge the petitioner on bail.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 1030 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
