IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 205 CR-5473-2026 Date of Decision: 20.07.2026 M/s Paisa Worth and another ...Petitioners Versus M/s Namya International ...Respondent
CORAM: HON'BLE MR. JUSTICE VIKAS SURI Present:- Mr. S.S. Tiwana, Advocate with Mr. Arshdeep Singh Brar, Advocate, for the petitioners. ***** VIKAS SURI, J. (Oral)
1. The present petition has been filed under Article 227 of the Constitution of India, for setting aside the orders dated 26.05.2026 and 02.07.2026 (Annexures P-12 and P-13, respectively), passed by the learned Executing Court.
2.
Learned counsel for the petitioners inter alia submits that recourse was straightway taken by the Executing Court to provisions under
Order XXI Rule 37 CPC without proceeding against the properties of the petitioners or recording satisfaction of dishonest disowning of the liability to pay, on the part of the judgment debtor. Reliance is placed upon the decision in Jolly George Varghese and another vs. The Bank of Cochin, reported in (1980) 2 SCC 360.
3.
Learned counsel for the petitioners, however, submits that the petitioners wish to settle the matter for all times, and undertakes to pay the entire outstanding amount within a period of two weeks from today.

4. To show their bona fides, petitioners volunteer to make an upfront payment of Rs.10,00,000/- before the learned Executing Court, in the shape of demand draft drawn in favour of the decree-holder, which may be handed over to the decree-holder forthwith and the said amount be adjusted against the total dues payable under the decree. The balance amount would be positively cleared within the aforesaid stipulated time, including up to date interest, towards full and final satisfaction of the decree.
5. The offer made before this Court, noted above, prima facie appears to be an earnest attempt to settle all pending dues under the decree.
6. On deposit of the aforesaid amount of Rs.10,00,000/-, the operation of the impugned orders dated 26.05.2026 and 02.07.2026, be kept in abeyance upto 03.08.2026, to enable the petitioners to make payment/deposit of the balance amount, as solemnly undertaken before this Court. In case the petitioners fail to do so, the Executing Court shall proceed further, in accordance with law, without being influenced by the present
order.
7. The amount, if any, paid in the interregnum, would be also accounted for against the full and final payment towards full satisfaction of the decree, besides the amount already paid, as alleged, subject to providing proper proof thereof and satisfaction of the learned Executing Court.
8. As the present revision is being disposed of in the absence of respondent, liberty is granted to it to seek recall/modification of the present
order, if valid grounds for the same are made out.
