By the said order, it was directed, inter alia, that ‘the operation of the punishment order dated 13.04.2026 shall remain stayed until further orders or till disposal of the O.A. , whichever is earlier’. In course of hearing, Mr. Bhattacharyya, learned senior advocate appearing for the original applicant/respondent informs this Court that the next date of hearing has been fixed before the learned Tribunal on 24th August, 2026. Mr. Trivedi, learned Additional Solicitor General appearing for the petitioners submits that in the event the interim order is allowed to continue and as the respondent is due to retire on 28th February, 2027, the petitioners herein would not be able to recover the benefits to be granted to the respondent in terms of the order impugned. Such argument of Mr. Trivedi is not acceptable to this Court and, in view thereof, we are not inclined to interfere with the order impugned. The writ petition is, accordingly, disposed of with a request to the learned Tribunal to dispose of the pending original application, as expeditiously as possible. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties. (Atarup Banerjee, J.)
