2 W.P.No.15372 of 2026 O R D E R: This petition is filed under Article 226 of the Constitution of India to issue an appropriate writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents Nos. 5 to 8 in making efforts for the construction of Ayushman Arogya Mandir (AAM) over the petitioner's subject property admeasuring Ac. 2.58 cents in Sy. Nos. 242/1, 243/1 and 243/2 of Surappakasam Village, Renigunta Mandal, Tirupati District, without considering the Final Layout Approval issued by the respondent no. 3 vide L.P. No. 2/2025/1166/TUDA/DPMS dated 02-04-2025, for a residential layout of 32 plots with 12 meter and 9 meter proposed roads, park and utility areas as highly arbitrary, illegal and amounts to infringement of fundamental rights of the petitioner guaranteed under Article 21 of the Constitution of India and consequently direct the respondents not to undertake any further illegal construction, excavation or work of any nature within the petitioner's layout at Sy. Nos. 242/1, 243/1 and 243/2 of Surappakasam Village, Renigunta Mandal, Tirupati District, pending disposal of this petition duly restoring all damaged infrastructure, trees and boundaries to their original condition and also to stop facilitating, aiding, or abetting the illegal encroachment upon the petitioner's property. 2. The case of the petitioners is, briefly stated, as follows: The petitioner is the owner of the above stated land admeasuring Ac. 2.58 cents. Mortgage deed was released on 01.01.2026 and a formal statutory recognition was completed. The petitioner executed a registered gift deed vide Doc. No. 8456 / 2025, dated 01.12.2025, Sub- Registrar, Renigunta in favour of Surappakasam Gram Panchayat, gifting an extent of 3611.29 square yards for the above said purposes. While so, without any prior notice, the respondent officials and contractors acting under the respondents Nos.
6, 7 and 8, accompanied by local
3 W.P.No.15372 of 2026 political leaders forcibly entered into the petitioner’s fully developed TUDA approved residential layout with JCB excavators, uprooted the planted trees, destroyed the drip irrigation pipelines and boundary demarcation structures, and commenced excavation purportedly for constructing an Ayushman Arogya Mandir (AAM), photographs are enclosed. Hence, this writ petition is filed. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of the written instructions of the respondent No.5, dated 19.06.2026, wherein it was mentioned that the subject lands were converted from agriculture to non-agricultural purpose i.e. commercial / residential vide the proceedings of the R.D.O., Srikalahasti vide D.Dis.(C) / 703 / 2024, dated 20.12.2024 and that the subject lands are not proposed for public purpose by this respondent at any point of time. 4. In view of the written instructions, the learned counsel for the petitioner requested to dispose of the writ petition recording the statement made in the written instructions. 5. Accordingly, the writ petition is disposed of recording the same. There shall be no order as to costs.
