Report in the form of affidavit filed by the State is taken on record. Learned counsel for the petitioner submits that the petitioner applied for the post of Sahayika before the District Level Selection Committee and qualified in the written examination. He was shortlisted for viva voce/ interview by the competent authority and was scheduled to appear before the authority on 26th May,
2026. The petitioner had no knowledge about the said date and immediately upon learning the same, submitted a representation before the concerned authority on 19th June, 2025 seeking an opportunity to appear before the authority for the viva voce. The representation is yet to be considered. It appears that interviews were scheduled to be conducted from 8th April, 2025 to 30th June, 2025. It is a fact that the petitioner did not appear before the concerned authority on the date fixed for his interview, that is, on 26th May, 2026. However, since the
2 representation was submitted by the petitioner within a period when the interviews were still continuing, the same ought to have been considered by the authority sympathetically in view of the exceptional circumstance stated by the petitioner. Accordingly, the writ petition is allowed. The District Magistrate, being the 3rd respondent herein is directed to consider and dispose of the representation submitted by the petitioner dated 19th June, 2025 sympathetically within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
