At the outset, learned counsel for the parties would submit that the plaint has been rejected by the learned trial Court on an application filed by the defendants under Order 7 Rule 11 of CPC, and therefore, nothing survives for adjudication in the present writ petition. 2. Learned counsel for the petitioner would submit that since the proceeding before the learned trial Court has already been terminated, he does not want to press the present writ petition. 3. In view of the submissions made by learned counsel for the petitioner, the present writ petition is dismissed as not pressed, however, the petitioner is at liberty to take all available grounds in the appropriate proceedings.
