Learned advocate appearing for the respondent nos. 4 to 6 submits that the respondent 4 had expired prior to the institution of the writ petition. Death certificate of the respondent no. 4 handed up to Court is taken on record. 2. Mr. Halder, learned advocate appearing for the petitioner submits that, the respondent no. 4 had been arrayed as a party respondent to present writ petition only because he was objecting to supply being effected in favour of the petitioner, therefore as the respondent no. 4 has died, his name may be expunged from the writ petition. In such view of the matter, the name of the respondent no. 4 stands expunged from the writ petition. 3. The writ petitioner has approached this Court complaining of inaction on the part of the
2 respondent CESC authorities in effecting electricity supply to the petitioner’s residential premises. 4. Mr. Halder submits that the petitioner’s application for electricity supply has been accepted by the CESC Limited and the bill raised by the electricity licensee towards service charge and security deposit has also been paid by the petitioner. It is submitted that despite payment being made, the electricity licensee has not provided electricity supply to the petitioner. 5. Mr. Sharma, learned advocate appearing for the CESC authorities submits that CESC authorities are ready and willing to effect electricity supply in favour of the petitioner but they could not do so because of the resistance that was put up by the private respondents. 6. Learned advocate appearing for the respondent nos. 3, 5 and 6 submits that the private respondents do not have any objection to the petitioner receiving electricity supply. 7. In view of the aforesaid submission as also be fact that CESC authorities are ready and willing the effect supply in favour of the petitioner, there is no reason to keep this writ petition pending. CESC authorities are directed to effect supply in favour of the petitioner at the relevant premises in terms of the petitioner’s application for supply of electricity.

In case, CESC authorities face any resistance at the instance of the private respondents, the CESC authorities will be free to approach the Officer-in- Charge, Khardaha Police Station seeking police assistance. If the Officer-in-Charge, Khardaha Police Station is approached by the CESC authorities, the said Officer-in-Charge shall afford adequate Police assistance to the CESC authorities. Costs for such Police assistance would be borne by the petitioner. 9. It is expected that the CESC authorities would effect supply in favour of the petitioner within three weeks from date. 10. Accordingly, WPA 20203 of 2026 stands disposed of. No Costs. 11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
