Paul, Advocate …for the Union of India 1. Petitioner is a lady. 2. Petitioner renews the prayer for bail. Petitioner is in custody since June 1, 2024. 3. Trial is in progress. Out of 8 prosecution witnesses, two were examined. Next date of trial is fixed on May 16, 2026. 4. Likelihood of the trial concluding any time soon is remote in view of the fact that, Special Intensive Revision (SIR) of the electoral process underway in the State of West Bengal. 2 5. On the principles of Article 21 of the Constitution of India, in my view, interest of justice should be subserve by granting bail to the petitioner. 6. Accordingly, I direct that the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Court of Learned Additional Sessions Judge, First Court Cooch Behar cum Learned Special Judge (under NDPS Act), subject to condition that the petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 7. In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 8.
