Learned advocate for the petitioner submits that the petitioner is in custody for more than three years and till date only four witnesses out of the 27 witnesses cited by the prosecution have been examined. The petitioner claims that two of the accused persons have been granted bail: one by the Hon’ble Supreme Court and the other by the Hon’ble High Court. The order of the Hon’ble Supreme Court speaks that the person (accused) who was granted bail was not identified in the T.I. parade. I have taken into account the complicity of the present petitioner and the fact that the petitioner was identified in the T.I. Parade; money was recovered from him
2 and arms were recovered pursuant to the leading statement of the petitioner. Having considered the overall circumstances, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, liberty is granted to the State to complete the witnesses at least the vital witnesses within a period of five months from date. The petitioner will renew his prayer for bail after the aforesaid time period is over. Accordingly, CRM (M) 1686 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Learned advocate for the State would communicate this order to the learned trial court. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
