This fact came into knowledge of applicant in the first week of July, 2026, therefore, delay of 348 days has been occurred. He submits that delay is bona fide and not intentional. Hence, the delay may be condoned. 3. Considering the reasons assigned in the application, nature of original case and considering the submission of the applicant, IA No.1 is allowed. Delay in filing the MCC is condoned. 4. Heard on application for restoration of MAC No.820/2021 (Smt. Draupati and another Vs. Executive Engineer) which was dismissed for want of prosecution on 23.06.2025 by this Court. 5. Taking into consideration the submission of learned counsel for the applicant and the reasons assigned in the application, I am inclined to allow the instant MCC. 6. Accordingly, the MCC is allowed.
