Learned advocate appearing for the petitioners submits petitioners are in custody for more than 7 months. Charge sheet has already been submitted before the jurisdictional Court.
Learned advocate for the State opposes the prayer for bail and submits that another accused is absconding, as such, the trial cannot be proceed.
On perusal of the case diary I find in the Chemical Examiner’s Report presence of Diacetylmorphine and 6- Monoacetylmorphine. The quantum of recovery in the present case is 266 Gms. of Heroin.

Having considered that the judgment of Sentu Seikh vs. State of West Bengal (SLP (Crl.) No. 13987/2025) is applicable to the present case, I am inclined to release the petitioner on bail. Accordingly, Petitioners, namely, (1) Md. Imran, (2) Md. Tasbir Ansari shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Asansol, Paschim Bardhaman. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Bardhaman without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1706 of 2026 is allowed.
