216 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH -.- CRM-M-8864-2026 (O&M) Date of Decision : 21.07.2026 Satpal ....Petitioner VERSUS State of Haryana ....Respondent CORAM : HON'BLE MR. JUSTICE N.S.SHEKHAWAT Present: Mr. Sunil Kumar Sharma, Advocate for the petitioner. Mr. Rajiv Sidhu, Sr. DAG Haryana. -.- N.S.SHEKHAWAT J. (Oral) 1. The petitioner has filed the instant petition under Section 439 of the Cr.P.C. with a prayer to grant regular bail in case FIR No.108 dated 21.04.2024 registered under Sections 15C/25/29/61/85 of NDPS Act at Police Station Ding, District Sirsa. 2. Learned counsel for the petitioner submits that as per the case of the prosecution Vikas Kumar, the main accused was apprehended by the police while he was carrying 2245 kg of poppy-husk in a truck. Upon his arrest, Vikas Kumar suffered a disclosure statement that Om Parkash, owner of the truck had handed over poppy-husk to him and Om Parkash was also nominated as an accused in the present case. He further submits that in the disclosure statement of Vikas Kumar, name of Jagdeep Singh alias Vikka had also appeared and he was also arrested in the present case on 01.05.2025. However, no recovery was effected from him. After his arrest, Jagdeep Singh alias Vikka further suffered a disclosure statement and named the petitioner and his co-accused. Name of the petitioner also appeared in the disclosure statement suffered by one Ram Chander. He further contends that Jagdeep Singh alias Vikkas has been granted concession of regular bail by this Court on 23.07.2025. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court. However, learned State counsel submits that the petitioner is not involved in any other criminal case. 4. I have heard the learned counsel for the parties and perused the record with their assistance. 5. In the present case, admittedly no recovery was effected from the present petitioner and he is stated to be in custody for the last more than 02 years and 03 months. Further the challan has already been presented against him and he is not in a position to tamper with the prosecution evidence. Moreover, his case is at par with Jagdeep Singh alias Vikka, who has already been granted concession of regular bail by this Court on 23.07.2026. Thus, further custody of the petitioner will not serve any meaningful purpose. 6. Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned. 7. Pending application(s), if any, is/are disposed of.
