Petitioners are ladies who were earlier on bail and for their absence learned Trial Court issued warrant of arrest. Petitioner in CRR 1070 of 2026 challenged the issuance of warrant with an undertaking to surrender before the learned Trial Court.
Learned advocate for the defacto complainant opposes the bail and challenges the conduct of the present petitioners.
Learned advocate for the State opposed the prayer for bail.

I have taken into account that the petitioners were initially granted bail on 24.06.2024. Thereafter warrant of arrest was issued. Petitioners surrendered before the learned Trial court and have been taken into custody.
Having considered the overall circumstances, I am inclined to release the petitioners, who are ladies, on bail. Accordingly, Petitioners, namely, (1) Parvina Bibi and (2) Osefa Bibi @ Asefa Bibi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court. With the aforesaid observations CRM (M) 1094 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
