The petitioner has filed the instant petition seeking following reliefs:- “(i) That, this Hon'ble Court may kindly be pleased to issue a Writ, Order, or Direction in the nature of Certiorari quashing the Impugned Ex-Parte Arbitral Award dated 14.01.2020 passed by learned Sole Arbitrator in Arbitration Case No. 3857/TRBRZ/384/2018 (Annexure-P/1) as far as it relates to the Petitioner (Shatrughan Lal Verma). (ii) That, this Hon'ble Court may kindly be pleased to issue a Writ, Order, or Direction quashing all consequential execution proceedings pending against the Petitioner in Transfer Decree (TD) Case No. 165/2024 (Shriram Finance Ltd. v. Ashwini Kumar & Anr.) before the Court of Vth Additional District Judge, Durg (C.G.) (Annexure-P/2). (iii) That, this Hon'ble Court may kindly be pleased to call for the entire record pertaining to Arbitration Case No. 3857/TRBRZ/384/2018 and Transfer Decree (TD) Case No. 165/2024; (iv) Grant any other relief or direction that this Hon'ble Court may deem fit, just, and proper in the facts and circumstances of the case, together with the costs of the petition. 2. At the outset, learned counsel for the petitioner submits that he may be granted liberty to file an appropriate application under Section 34 of the Arbitration and Conciliation Act, 1996 before the competent Court. Learned counsel for the petitioner further prays that the petitioner be permitted to file the said application within a period of 15 days. 3 3. Learned State counsel submits that he has no objection to the aforesaid prayer. 4. Having heard learned counsel for the parties and upon perusal of the material available on record, considering the facts and circumstances of the case, this Court deems it appropriate to grant liberty to the petitioner to file an appropriate application under Section 34 of the Arbitration and Conciliation Act, 1996 before the competent Court within a period of 15 days from the date of receipt of copy of this order. If such an application is filed within the aforesaid period, the same shall be considered and decided by the competent Court in accordance with law, without being influenced by any observations made in the present proceedings. 5.
