06-08-2026 Item no.25 Subrata Bhattacharyya AR(C) In the High Court at Calcutta Special Civil Jurisdiction Appellate Side WPCRC No.62 of 2025 Kakali Saha -vs- Dhaval Jain & Ors. arising out of WPA No.5283 of 2023 Mr. Pankaj Halder Mr. Bidish Ghosh Mr. Sanatan Panja …for the petitioner Mr. Srijan Nayak Ms. Susmita Chatterjee …for the contemnors 1. Learned counsel for the petitioner submits that certain unauthorised constructions on the third floor of premises no.45A, Banku Behari Chatterjee Road, Ward no. 67, Borough-VII under the Kolkata Municipal Corporation is yet to be demolished. 2. Learned counsel for the contemnors relies upon instructions forwarded by the Executive Engineer (Civil), Building Department, Borough-VII Kolkata Municipal Corporation signed on July 14, 2026 along with photographs and submits that the order passed by the Court has been complied with. 3. I have perused both the photographs produced by the learned counsel for the petitioner and the contemnors. It appears that substantial demolition work has taken place. As per the engineers of the Corporation, further demolition work may endanger the structure in question. 4. In view of the above, the Court is not inclined to proceed with the contempt proceeding any further. The same is disposed of. Contempt Rule is discharged. 5. The contemnors shall, however, keep strict vigil so that the demolished portions are not reconstructed in any manner whatsoever. 6. All parties are to act on the server copy of this order duly downloaded from the official website of this court. 7. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2
