CRM-M-26154-2026 (O&M) -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 218 CRM-M-26154-2026 (O&M) Decided on: 21.07.2026 LALI SINGH ……Petitioner Versus STATE OF PUNJAB ..…Respondent CORAM : HON'BLE MR. JUSTICE VIRINDER AGGARWAL Present: - Mr. Vishwajit Bedi, Advocate for the petitioner. Ms. Navreet Kaur, Asstt. AG, Punjab. Mr. Mohit Khatkar, Advocate with Mr. Raj Mehak Rana, Advocate for the complainant. VIRINDER AGGARWAL, J. (Oral) 1. The present petition has been instituted under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 439 of the Code of Criminal Procedure, 1973), seeking the concession of regular bail pending trial in connection with FIR No. 27 dated 14.03.2026, registered under Sections 115(2), 118(1), 351(2), 351(3), 126(2), 3(5) and 109 of the Bharatiya Nyaya Sanhita, 2023 (corresponding to erstwhile Sections 323, 324, 506, 341, 34 and 307 of the Indian Penal Code, 1860), at Police Station Bhadson, District Patiala (Annexure P-1). Briefly stated, the prosecution case is that the present FIR came to be registered on the statement of the complainant, Gurpreet Singh, alleging that on 13.03.2026, while he was returning to his village, he was allegedly intercepted by the present petitioner along with the other co- accused. It is alleged that, in furtherance of their common intention, the accused restrained the complainant and assaulted him with weapons including a 'Daat Loha', an iron rod and sticks, thereby causing injuries on his head and other parts of the body. On the basis of the aforesaid allegations, the present FIR was registered and the investigation was set into motion. 3. The custody certificate produced by the learned State counsel is taken on record, subject to all just exceptions. 3.1. Learned State counsel, duly assisted by learned counsel appearing for the complainant, has vehemently opposed the prayer for grant of regular bail, contending that, having regard to the nature, gravity and seriousness of the allegations, as well as the manner in which the offence is alleged to have been committed, the petitioner does not deserve the concession of regular bail at this stage. It is further submitted that the allegations disclose the petitioner's active participation in the occurrence and, therefore, no ground is made out for extending the discretionary relief of regular bail. Accordingly, it is prayed that the present petition, being devoid of merit, deserves to be dismissed. GAURAV SOROT 2026.07.22 17:02 I attest to the accuracy and integrity of this document CRM-M-26154-2026 (O&M) -3- 4. I have heard the learned counsel for the respective parties at considerable length and have carefully examined the paper book as well as the material placed on record with their able assistance. 5. Upon an overall consideration of the facts and circumstances of the case, this Court finds that the petitioner has been in judicial custody since 20.03.2026. The allegation specifically attributed to him is confined to causing a blow below the right eye of the complainant, which has been declared simple in nature. The more serious allegation relating to the head injury has been attributed to co-accused Jagsir Singh, who has not yet been apprehended. It further emerges from the record that the occurrence has resulted in cross-cases, and injuries have also been suffered by the petitioner, thereby rendering the rival versions disputed questions of fact requiring adjudication during trial. At this stage, a meticulous appreciation of the evidence would be wholly impermissible. Since the investigation stands concluded and the trial is at an initial stage with no immediate likelihood of its conclusion, continued incarceration of the petitioner would serve no fruitful purpose. Accordingly, without commenting upon the merits of the prosecution case, this Court is satisfied that the petitioner has made out a case for grant of regular bail. 5.1. Consequently, the present petition is allowed, and the applicant-petitioner is ordered to be released on regular bail, subject to his furnishing requisite bail and surety bonds to the satisfaction of the learned Chief Judicial Magistrate/Illaqa Magistrate/Duty Magistrate concerned, as the case may be, and subject to the following conditions:- GAURAV SOROT 2026.07.22 17:02 I attest to the accuracy and integrity of this document CRM-M-26154-2026 (O&M) -4- i.
