The grievance of the petitioner is that while passing the impugned transfer order, the provisions contained in Clauses 3.15 and 4.1 of the Transfer Policy have not been taken into consideration and the transfer order has been issued in violation thereof. 2. Learned counsel for the petitioner submits that, in terms of Clause 8 of the Transfer Policy, the petitioner has already submitted a representation dated 05.08.2026 before the competent authority. Learned counsel for the petitioner 3 further submits that the petitioner has been sanctioned Child Care Leave for a period of five months, i.e., from 02.06.2026 to 02.11.2026, and that the petitioner’s child is presently seven months old. In view thereof, it is prayed that the effect and operation of the impugned transfer order may be stayed till the decision on the petitioner’s representation. 3. Learned State counsel submits that, if the representation submitted by the petitioner is pending consideration, the same may be directed to be considered and decided within a stipulated period. 4. Accordingly, without expressing any opinion on the merits of the grievance raised by the petitioner, the writ petition is disposed of with a direction to the Committee constituted under the Transfer Policy to consider the representation dated 05.08.2026 submitted by the petitioner, in accordance with the applicable provisions of the Transfer Policy, and pass a reasoned and speaking order thereon within a period of twenty days from the date of receipt of a copy of this order. 5. Accordingly, the writ petition is disposed of with a direction to the Committee constituted under the Transfer Policy to consider and decide the representation dated 05.08.2026 4 submitted by the petitioner, in accordance with the applicable provisions of the Transfer Policy, and pass a reasoned and speaking order thereon within a period of twenty days from the date of receipt of a copy of this order. Considering the fact that the petitioner is presently on sanctioned Child Care Leave and has a seven-month-old child, the effect and operation of the transfer order dated 04.08.2026, insofar as the petitioner is concerned, shall remain stayed till the decision on the aforesaid representation by the Committee. 6.
