Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 11 months and till date charges have not been framed. There is no possibility of the trial to be taken to its logical conclusion, as such, the petitioner may be released on bail.
Learned advocate for the State opposes the prayer for bail.
I direct the learned trial court to split up the trial of the case if there is an absconding accused and thereafter overcome the stage of consideration of charges. Priority be given for examination of the independent seizure list witnesses. Petitioner will renew his prayer for bail after the evidence of the independent seizure list witnesses are over.
