IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 129 LPA-1117-2026 (O&M) Date of Decision :14.07.2026 Raj Kumar and others
..Appellants
Versus State of Haryana and others ...Respondents
CORAM:
HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI HON'BLE MR. JUSTICE AMARINDER SINGH GREWAL
Present: Ms. Shruti Jain Goyal, Advocate for the appellants. * * * Harsimran Singh Sethi, J. (Oral)
1. Present appeal has been filed challenging the order dated 11.02.2026 passed by the learned Single Judge of this Court in CWP-8997- 2015 by which, the plea raised by the appellants herein, who are working as Constable (Computer Operator) so as to grant them the grade pay of Rs.3200/- as in the pay scale of Rs.9300-34800/-, instead of grade pay of Rs.2400/- in the pay scale of Rs.5200-20200/-,which is the same pay being given to the Constables, who are working as Pharmacists, has been rejected
2.
Learned counsel for the appellants submits that the appellants are operating the computers and are in fact doing the job of Computer Operators and therefore, they should be given the benefit of the pay scale as being given to the Computer Operators working in the State of Haryana.
3.
Learned counsel for the appellants further submits that once, the AARTI SHARMA 2026.07.20 09:35 I attest to the accuracy and integrity of this document
LPA-1117-2026 (O&M) -2- appellants are doing the same job as being done by the Computer Operators working in the State of Haryana, non-grant of the benefit of equal pay is arbitrary, which fact has been ignored by the learned Single Judge of this Court. 4. We have heard learned counsel for the appellants and have gone through the record with her able assistance. 5. It may be noticed that the designation on which the appellants are working is Constable (Computer Operator). Once, the appellants have been recruited as a Constable on a particular pay scale, they are rightly being granted the said benefit. The claim of higher pay scale as being given to the Computer Operators in the State of Haryana is not made out especially when, nothing has been brought on record to show as to what are the duties of the Computer Operators working in the State of Haryana and the Constables, who are working as Computer Operators in the police department. 6. Further, it is a settled principle of law that even different qualifications prescribed for recruitment can be a good ground to prescribe different pay scales. Nothing has been shown to this Court that the qualifications for appointment as a Constable (Computer Operator) are the same as being adhered to while appointing the Computer Operator in the State of Haryana. 7. In the absence of any such data brought before this Court, the learned Single Judge was right in holding that merely as the Constables are working as Computer Operator, they cannot claim themselves equivalent to the Computer Operator working in the State of Haryana so as to be granted AARTI SHARMA 2026.07.20 09:35 I attest to the accuracy and integrity of this document
LPA-1117-2026 (O&M) -3- the same pay scale. 8. Keeping in view the facts and circumstances recorded hereinbefore, no perversity in the impugned order dated 11.02.2026 was found or has been pointed out by learned counsel for the appellants hence, no ground for interference by this Court is made out and the appeal is accordingly dismissed. 9. Civil miscellaneous application pending, if any, is also disposed of.
