1. Petitioner has filed this petition under Article 226 of the Constitution of India with following reliefs:
“10. Reliefs Sought: I. That this Hon'ble court may kindly be pleased to quash the order dated 27/09/23 passed by the collector. II. That, this Hon'ble Court may kindly be pleased to direct the Respondent Authorities to handover the actual physical possession of the secured property, as mentioned in its application filed under section 14 of SARFAESI Act, to the petitioner. III. Any other relief/relief's, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the petitioner.”

Learned counsel appearing for respondent No.5 submits that the entire loan amount has already been paid by respondent No.5 to the present petitioner and to this effect closure letter (NOC) dated 29.08.2024 has also been issued. Said closure letter specifically records that upon execution of this letter, neither of the parties mentioned herein will have any claim of whatsoever nature against the other. Closure letter has been placed on record along with covering memo dated 29.07.2025. In view thereof, learned counsel submits that present writ petition has become infructuous.

3. None appeared on behalf of the petitioner to controvert the statement made on behalf of respondent No.5 or to otherwise substantiate and prosecute the present petition.
4. Upon perusal of the closure letter, it appears that no claim whatsoever remains against either party.
5. In view of the aforesaid facts and circumstances, nothing further survives for consideration in the present writ petition.
6. Accordingly, the instant writ petition stands disposed of as having become infructuous. CC as per rules.
