The writ petition is filed to seek to issue a certiorari to quash the order dated 07.02.2024 passed by the DRT in S.A.No.575/2023 vide Annexure-D. 3. Counsel appearing for the respective parties presented several contentions. Heard the argument and perused the papers with utmost care. 4. Suffice it to note that the Bank had filed a petition under Section 14 in Crl.Misc.No.3764/2016, which was allowed by the Trial Court vide order dated 26.04.2023. Aggrieved by the said order, the petitioner approached this Court in W.P.No.14126/2023, which came to be disposed of on 24.08.2023. Thereafter, the petitioner approached the DRT and challenged the Section 14 order in S.A.No.575/2023. The DRT, by its order dated 30.11.2023, passed a conditional interim order, which the petitioner duly complied with. Thereafter, counsel appearing for the respective parties addressed - 3 - HC-KAR CNR: KAHC010101502024 NC: 2026:KHC:42420 WP No. 4806 of 2024 arguments and the DRT vide order dated:07.02.2024 heard the arguments and posted the matter for orders. The grievance of the petitioner is against the said order. However, such grievance cannot be sustained. As noted above, the petitioner had complied with the conditional interim order, and thereafter, the only course available to the DRT was to post the matter for orders. Further, both the petitioner and the respondent had addressed their respective arguments before the DRT. Having taken note of the submissions made by both parties, the DRT rightly posted the matter for orders. Therefore, the petitioner cannot have any legitimate grievance against the impugned order.
