JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before the court seeking the following prayers: "(A) Order and direct the 1st Respondent to hand- over to Criminal Investigation Department (CID) Investigation / further investigation and further proceedings of C.C.No.17809/2025 arising out of Crime No.254/2024 registered at Jnanabharathi Police Station, Bengaluru and pending before VI Addl. C.M.M, Court, at Bengaluru, with direction to (i) Conduct full forensic examination / retrieval of all digital / electronic devices including deceased's mobile, laptop and Lenovo Tablet through FSL Madivala, Bengaluru or through FSL Hyderabad; (ii) Further investigate the removal / tampering of the deceased's diary pages and her mobile and the destruction of evidence; (iii) Include prior criminal records of the Accused as part of the evidence to establish motive and habitual misconduct towards the deceased; (iv) Examine and investigate all financial transactions, loans and coercive practices by the Accused with the deceased to establish extortion, harassment and abetment; (v) Ensure that the deceased's mental, physical emotional abuse by the Accused leading to her suicide is thoroughly investigated and reflected in the final Charge Sheet; (vi) Grant any other reliefs that are deemed just and necessary, in the interest of justice and to secure ends of justice." - 4 - HC-KAR NC: 2026:KHC:18921 WP No. 37689 of 2025 2. Heard Smt.Hemalata Mahishi, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent Nos.1 to 3 and have perused the material on record. 3. The prayer of the petitioner is seeking further investigation into the matter. The further investigation is sought on the score that the digital devices are collected but not sent to the FSL but sent to Basaveshwaranagar police station. 4. The learned Additional SPP submits that there is a requisition made to the Court of Session on 23.03.2026 seeking the digital devices to be sent to the FSL. Once the permission is granted, the digital devices would be sent to the FSL. 5. The learned counsel for the petitioner submits that permission was already taken but they have not sent it. 6. The Additional SPP would undertake that it would be sent to the FSL without any further delay once the permission is granted. - 5 - HC-KAR NC: 2026:KHC:18921 WP No. 37689 of 2025 7. In the light of the aforesaid submission, once the permission comes about, a holistic further investigation be conducted by the prosecution. In the event of need, the petitioner is at liberty to knock at the doors of this court at a later point in time. 8. For the aforesaid reasons, the Writ Petition is disposed.
