V/s
STATE OF HARYANA
.…Respondent
CORAM: HON'BLE MR. JUSTICE VIKRAM AGGARWAL
Present: Mr. Manmeet Singh Rana, Advocate and Mr. Aaryan Kargwal, for the petitioner.
Ms. Vasundhara Dalal Anand, Sr. D.A.G., Haryana.
Mr. Ravi Rana, Advocate, for the complainant.
*** VIKRAM AGGARWAL, J. (ORAL)
Prayer in the present petition preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short the ‘BNSS’) is for the grant of regular bail to the petitioner in case FIR No.17 dated 26.01.2025 registered under Sections 316 (2), 318 (4) and 351 (2) of BNS, 2023 at Police Station Naggal, District Ambala.
2.
Custody certificate filed in Court today is taken on record.
3.
On a complaint submitted by one Amit Kumar, the FIR in question was registered. The allegation was that a sum of Rs.47,45,000/- had been swindled by the petitioner and two co-accused namely Munish Gill alias Rajnish and Preeti on the pretext of sending the complainant to Australia. The petitioner was arrested on 18.09.2025 and is in custody since then.
4.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that investigation stands completed; final report stands submitted; however, charges have not been framed; trial MANI KUMAR 2026.07.21 19:23 I attest to the accuracy and integrity of this document

will, therefore, take a sufficiently long time and no useful purpose would be served by keeping the petitioner in custody any longer.
5.
Per contra, learned State counsel and learned counsel for the complainant have opposed the bail application, stating that the petitioner is a habitual offender, four other FIRs of similar nature having been registered against him.
6.
I have considered the submissions made by learned counsel for the parties.
7.
No doubt, the allegations are serious. The antecedents of the petitioner are also not too clean as four other cases of similar nature stand registered against him. However, the fact remains that the prayer in the present petition is for grant of regular bail, the petitioner is being in custody for the last 10 months. Investigation stands concluded; final report has been submitted; though charges are yet not been framed. It is therefore, clear that trial will take a sufficiently long time and in the considered opinion of this Court, no useful purpose would be served by keeping the petitioner in custody any longer.
8.
In view of the aforementioned facts and circumstances, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.
9.
Pending application(s), if any, shall also stand disposed of.
