Matter is taken up for consideration in terms of order dated 30th July, 2026 in presence of learned advocates representing petitioner and State respondents. 2. In spite of service of notice, respondent nos.6, 7 & 8 are not represented. 3. A communication dated 13th August, 2026 of Inspector- in-Charge, Maheshtala Police Station is filed today and same is taken on record though vide order dated 30th July, 2026 Inspector-in-Charge, Maheshtala Police Station was directed to file a report, not a communication addressed to learned Government Pleader. 4. From the said communication dated 13th August, 2026 it appears that residents of locality where petitioner is making construction raised objection for carrying building materials using a pathway from main road to the building of petitioner. However, such objection does not survive in view of sanctioned plan accorded to [2] petitioner permitting petitioner to make construction of G+1 storied building. 5. In paragraph 6 of the writ petition there are averments that sanctioned building plan was issued in favour of petitioner and in support of same a document is enclosed at page 51 of the writ petition. 6. Petitioner is permitted to appear before Inspector-in- Charge, Maheshtala Police Station being respondent no.5 by 17th August, 2026 and produce sanctioned building plan. 7. If it is found that building plan sanctioned by concerned Municipality permits petitioner to raise construction upto G+1 level, in that event, concerned police authorities are directed to provide assistance to petitioner which would permit petitioner to make construction. Any obstruction by local residents shall be appropriately dealt with, in accordance with law. 8. With the aforesaid directions writ petition stands disposed of. 9.
