2 calculation of compensation determined on account of submergence of the petitioner's land bearing Khasra No.905/1, admeasuring 0.045 hectare, situated at Village Kekrabhhat, Tehsil Dabhara, District Sakti, acquired for the construction of Ghatoi Dam, before passing of the final award. 2
Learned counsel for the petitioner submits that the petitioner is the owner of land bearing Khasra No.905/1 admeasuring area 0.045 hectare situated at Village Kekrabhhat, Tehsil Dabhara, District Sakti. He submits that the aforesaid land is coming under submergence on account of construction of Ghatoi Dam and, pursuant to the directions issued by this Court, land acquisition proceedings have been initiated under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It is submitted that the Land Acquisition Officer has calculated the compensation and issued a demand letter to the requiring department. However, there is an error in the calculation of compensation inasmuch as the hectare rate has been applied instead of the applicable square metre rate, contrary to the prevailing guideline issued under the Indian Stamp Act, 1899. In this regard, the petitioner has preferred a representation (Annexure P/2) before the Collector, Sakti, which is still pending consideration. Learned counsel further submits that the final award has not yet been passed and, therefore, if Respondent No.3 is directed to consider and decide the pending
3 representation before passing the final award, the grievance of the petitioner would stand substantially redressed. 3 Considering the limited prayer made by the petitioner, Respondent No.3 is directed to consider and decide the representation preferred by the petitioner, strictly in accordance with law, after affording due opportunity of hearing to the petitioner, within a period of 60 days from the date of receipt of a copy of this order or before passing the final award, whichever is earlier. 4 It is made clear that this Court has not expressed any opinion on the merits of the claim raised by the petitioner and the competent authority shall independently consider the petitioner's representation in accordance with law. 5 Accordingly, this Writ Petition stands disposed of with the aforesaid direction. No order as to costs.
