Learned counsel for the petitioner has not controverted the said fact and has also supported that it was respondent No.2 who was proprietor of respondent No.1 firm as well. Since the present petition has been filed against the order of acquittal of respondent No. 2, the same has been rendered infructuous on account of his death.
