ORAL JUDGMENT
This appeal is filed by the appellant/claimant under Section 173(1) of Motor Vehicles Act, 1988 challenging the
judgment and award dated 02.01.2017 passed in MVC No.2867/2015 on the file of the MACT Court Of Small Causes and XXI ACMM and XIII ASCJ Bengaluru, for enhancing the compensation.
2. Learned counsel for the both parties are present.
3. Both the counsel jointly requested for remanding the matter to the Tribunal. Therefore, the appeal is remanded to Tribunal for fresh consideration.
4. Accordingly, I pass the following:
ORDER i. The appeal is allowed and remanded; ii. The Tribunal is specifically directed to give reasonable opportunity to both sides for

adducing evidence, arguments and to dispose of the matter on merits by duly considering the entire evidence on record within 2 months from the date of the order as it is a matter of 2014; iii. Both the counsels are directed to co-operate with the Tribunal for disposal of the case within the stipulated time; iv. Registry is directed to send back the records, along with the IA and the medical report to the Tribunal within 10 days; v. Both the parties are directed to appear before the Tribunal on 17.08.2026 and vi. All contentions of the parties are kept open.
