The petitioner has filed this writ petition challenging the order impugned dated 18-2-2019 (Annexure P-1) passed by respondent No.2, by which the appeal preferred by him against his dismissal from service has been rejected. Ms. Shraddha Mishra, learned counsel appearing on behalf of the petitioner, would submit that the appeal has been dismissed without passing reasoned and speaking order as required under Rule 27(2) of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 (for short, ‘the Rules of 1966’).
3. Mr. Sharad Mishra, learned State counsel appearing on behalf of the respondents/State, would support the impugned order and oppose the writ petition.
4. A careful perusal of the order impugned would show that in one paragraph at page 13 of the writ petition, the appeal has been dismissed without passing reasoned and speaking order as required under Rule 27(2) of the Rules of 1966.
5. In that view of the matter, the order impugned dated 18-2-2019 (Annexure P-1) is set aside and the appellate authority is directed to pass order afresh keeping in mind the provision contained in Rule 27(2)(b) of the Rules of 1966, within a period of 45 days from the date of receipt of a copy of this order, in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the matter.
