1. Memo of evidence filed in Court be taken on record. 2. It is submitted by the learned Advocate appearing for the petitioner that the petitioner is the foster daughter of the de facto complainant. It has been alleged that the petitioner was given in marriage by the de facto complainant. Gold ornaments and other valuables as well as some immovable properties were gifted to the petitioner by the de facto complainant. It is the allegation made in the First Information Report that the petitioner removed

the gold ornaments lying in joint locker and used the same to her own benefits. 3. Learned Advocate appearing for the petitioner submits that no such incident ever took place. The gold ornaments were actually gifted by the de facto complainant to the petitioner as his foster daughter at the time of her marriage. He prays for anticipatory bail. 4. Learned Advocate appearing for the State opposes the prayer for anticipatory bail and submits that the investigation is going on. 5. Learned Advocate appearing for the de facto complainant submits that there are several civil disputes pending in between the parties. He also opposes the prayer for anticipatory bail. 6. Learned Advocate appearing for the petitioner also submitted that in such civil disputes at their behest, the de facto complainant was restrained from interfering with the possession of the immovable property of the petitioner. 7.
Heaving heard the learned Advocates appearing for the parties and on perusal of the materials in the case diary including the statements of the witnesses, it appears that there are serious property disputes in between the petitioner and the de facto complainant. It is not denied that the petitioner happens to be the foster daughter of the de facto complainant. The disputes are said to have cropped up after the de facto complainant remarried after the death of his first wife. There are several civil litigations

pending in between the parties. 8. In the aforesaid facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 9. Accordingly, I direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioner will cooperate with the investigation till the conclusion of the investigation and on condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 10. The prayer for anticipatory bail of the petitioner is allowed. 11. C.R.M. (A) 2423 of 2026 is disposed of. (Md. Shabbar Rashidi, J.)
