JUSTICE TARA VITASTA GANJU ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI) Heard the learned counsel for the complainant and the learned counsel appearing for the accused. 2. The instant complaint is filed alleging disobedience of the order passed by this Court in Writ Petition No.16323/2024 dated 22.11.2024 along with modified order dated 19.12.2024. The direction given in the modified order - 3 - HC-KAR CNR: KAHC010463082025 NC: 2026:KHC:44526-DB CCC No. 894 of 2025 dated 19.12.2024 also incorporates the direction issued in the previous order dated 22.11.2024, which is as follows: "..……............. Accordingly, it is made clear that the respondent Nos.2 and 3 are directed to consider the representations at Annexure-K, Q and R in accordance with law with the aid of expert opinion report produced at Annexure-M." 3. The learned counsel appearing for the accused has referred to the affidavit of Smt.Susheelamma, the Managing Director of Karnataka Road Development Corporation, in which the cause for delay in deciding the representation has been explained in paragraph No.4, which also refers to the endorsement dated 30.10.2025 and the postal acknowledgment that have been enclosed as Annexures-A and B respectively to contend that the direction issued by this Court aforesaid has been complied with fully. 4. It is stated by the learned counsel for the accused that the expert report enclosed as Annexure - M to the writ petition formed part of the Annexures - K, Q and R to the writ petition, that is to say, the expert report that was enclosed as Annexure - M forms the basis of the Annexures - K, Q and R. - 4 - HC-KAR CNR: KAHC010463082025 NC: 2026:KHC:44526-DB CCC No. 894 of 2025 This submission is not disputed by the learned counsel for the complainant. 5. We further note that the said Annexures referred to in the order of 19.12.2024, are not enclosed with this petition. Having perused the endorsement dated 30.10.2025, we find that the aforesaid two orders of the Writ Court have been complied with. The contempt petition is, therefore, consigned.
