The learned advocate appearing for the petitioner submits that the matrimonial suit is pending from the year 2023. He further submits that the petitioner is also complying with the direction passed by the learned Trial Judge on an application under Section 36 of the Special Marriage Act. From the order sheets appended to this application, this Court finds that 8th September, 2026 is fixed for examination of PW-1. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Additional 2 District Judge, 10th Court, Alipore to take up the hearing of the Matrimonial Suit no. 2518 of 2023 on the next date fixed i.e. on 8th September, 2026 for examination of PW-1 and to make make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties, provided the petitioner is not in default of any payment of alimony pendente lite.
