JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent nos.1 to 7. 2. Notice to respondent no.8 is dispensed with in view of the proposed order to be passed. 3. Petitioner is before the court seeking for the following releifs: a. Issue a writ of mandamus directing the 5th respondent to initiate action in accordance with law on the complaint dated 24.07.2026 produced as Annexure-D given by the petitioner as against 8th respondent. b. Issue such other writ or directions as this Hon'ble Court deems fit. c. The grievance of the petitioner is that a complaint lodged by the petitioner in terms of Annexure-D2 on 24.07.2026 has not been acted upon. The allegations made in the said complaint is that the members of respondent no.8 had indulged in a protest in front of the premises of the petitioner, alleging that the petitioner has violated the lease granted to the petitioner and certain other allegations. 5. The submission of learned counsel for the petitioner is that since the jurisdictional police did not take any action, the petitioner has also submitted a representation on 24.07.2026 at Annexure-F2 enclosing the said complaint, despite which no action has been taken. 6. Subsequently, on 30.07.2026, the petitioner has also submitted a representation to the next higher officer, namely, respondent no. 2, who has also not taken any action. 7. A perusal of the complaint would indicate that the allegations made are in respect of non-cognizable offences which at most, constitute unlawful assembly. Such being the case, it is not required for the respondents to register a FIR in respect of a non- cognizable offence. - 5 - HC-KAR CNR: KAHC010539352026 NC: 2026:KHC:41592 WP No. 24414 of 2026 8. The petitioner has an alternative remedy of filing a necessary private complaint on account of the Station House officer as also the superior authority not taking any action in terms of the decision of the Hon'ble Apex Court in the case of Priyanka Srivastava & Another vs. State of Uttar Pradesh & Others reported in (2015) 6 SCC 287 . 9.
