Mr. Amit Baran Dash Ms. Ankana Sarkar ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Contai, District-Purba Medinipur to dispose of the Title Execution Case No.4 of 2022 and the J. Misc. Case No.48 of 2025 expeditiously. The learned advocate appearing for the petitioner submits that August 26, 2026 is fixed for hearing of the said miscellaneous case. She further submits that the said miscellaneous case was filed under the provisions of Section 47 of the Code of Civil Procedure. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2827 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 1st Court at Contai, District-Purba Medinipur to take up 2 the hearing of the J. Misc. Case No.48 of 2025 on the next date fixed i.e. August 26, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the said application as expeditiously as possible but preferably within a period of 4 months from the next date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the said miscellaneous case as well as any other miscellaneous case that may be pending, the learned Executing Court shall make an endeavour to dispose of Title Execution Case No.4 of 2022 expeditiously. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
